The lawsuit from author John Beiswenger, claiming that massive parts with the Assassin’s Creed story had been stolen from his book, Link, has been settled out of court. Ubisoft and Beiswenger have reached a settlement that can avoid a release delay of Assassin’s Creed III view Beiswenger’s voluntary dismissal from the suit.
A voluntary dismissal devoid of prejudice means that the plaintiff dismissed the situation of his personal accord and is free of charge to refile the claim inside a year with the voluntary dismissal. No settlement was reached. If a settlement had been reached it will be dismissal with prejudice meaning an agreement was reached and he couldn’t refile the suit at a later date. Having said that, the terminology nonetheless leaves issues open from Beiswenger to re-open the suit further down the line, and he claims that he nonetheless stands behind his belief that the source material is originally his. His representative had the following to say:
“My client’s choice to exercise his suitable to voluntarily dismiss the action, with no prejudice, in no way diminishes his stalwart conviction within the merit of his claims against Ubisoft. He is unwavering in his belief that numerous crucial components on the Assassin’s Creed video game franchise infringe on many crucial elements of his novel, Link. We think Ubisoft has engaged in egregious acts of copyright infringement and, need to he choose to seek redress through the courts inside the future, we stay confident that a trier of reality would agree.”
For all those that haven’t kept up using the story, Beiswenger claims that the concepts for the technologies employed inside the Animus device had been initial presented in his book, Link, a self-published novel that had incredibly small circulation. These exact same ideas were also present in books before Link, and this settlement basically proves that the complete suit was most likely just a cash-grab by a failed author attempting to produce some rapid coin.
